Privacy Policy
The short version: we only collect what we need to run your sand sculpture class, we don't sell your information, and you can always ask us what we have.
This Privacy Policy explains how Sand Art on PCH (“we,” “us,” or “our”) collects, uses and shares information when you visit SandArtOnPCH.com (the “Site”), send us a booking request, or book and pay for a class. Sand Art on PCH offers sand castle and sand sculpture classes on the beach in Dana Point, California.
1. Information we collect
Information you give us
- Booking requests. When you use our booking form, we collect your name, email address, phone number, preferred date, class type, and anything you write in the message box (for example, group size, ages, or a theme idea).
- Bookings and payments. When you book or pay online, our booking and payment provider (Square) collects your name, contact details, appointment details and payment card information. We never see or store your full card number — Square processes payments for us.
- Messages. If you call, text, email us, or message us on Instagram, we receive whatever you choose to share, such as your name, phone number, email and the content of your message.
Information collected automatically
- Usage and device information. Like most websites, our Site and the tools we use may automatically collect information such as your IP address, browser and device type, pages you visit, how you got to our Site (for example, from a Google ad or search), and approximate location (city or region, based on IP address).
- Cookies and similar technologies. We use, or may use, cookies from Google Analytics and Google Ads to understand how visitors use the Site and to measure how well our ads work. See Cookies, analytics & ads below.
- Hosting logs. Our web host (Netlify) keeps standard server logs, such as IP addresses and request times, to deliver and secure the Site.
2. How we use your information
- To respond to your booking request and questions, schedule your class, and send you confirmation details and the meeting spot.
- To process payments, refunds and cancellations (cancel at least 24 hours before your class for a full refund).
- To contact you about your booking — for example, about weather or a schedule change.
- To understand how people find and use our Site so we can improve it.
- To measure and improve our advertising, including Google Ads, and to show our ads to people who may be interested in a class.
- To keep our Site and business secure, prevent spam and fraud, and comply with the law.
We don't send marketing emails or texts unless you ask us to or agree to receive them, and you can opt out any time by replying “stop” or emailing us.
3. Who we share it with
We do not sell your personal information. We share it only with service providers that help us run the Site and our classes, and only as needed for them to do their job:
| Provider | What they do for us | Their privacy policy |
|---|---|---|
| Formspree | Receives booking form submissions and emails them to us | formspree.io/legal/privacy-policy |
| Square (Square Appointments) | Online booking, scheduling and payment processing | squareup.com/us/en/legal/general/privacy |
| Google Analytics | Website traffic and usage statistics | policies.google.com/privacy |
| Google Ads | Advertising and measuring ad conversions (such as booking requests) | policies.google.com/technologies/ads |
| Netlify | Website hosting | netlify.com/privacy |
Each provider handles information under its own privacy policy. We may also disclose information if required by law, to protect our rights or someone's safety, or as part of a sale or transfer of the business.
Our Site also links to other sites, such as Instagram and Airbnb Experiences, and shows a map from OpenStreetMap. Those sites have their own privacy practices, and this policy doesn't cover them.
4. Cookies, analytics & ads
Cookies are small files stored in your browser. We use, or may use, Google Analytics (via Google Tag Manager) to see things like which pages are popular, and Google Ads conversion tracking to see whether someone who clicked one of our ads went on to send a booking request. Google may use cookies to show our ads to people who have visited our Site, on Google and partner sites. Google's use of this data is described at How Google uses information from sites that use its services.
Your choices:
- Turn off personalized ads from Google at Google Ads Settings (My Ad Center).
- Opt out of Google Analytics on all websites with the Google Analytics Opt-out Browser Add-on.
- Opt out of interest-based ads from many companies at optout.aboutads.info or optout.networkadvertising.org.
- Block or delete cookies in your browser settings. The Site will still work, though some features may not.
- Global Privacy Control: if your browser sends a Global Privacy Control (GPC) signal, we treat it as a request to opt out of the “sharing” of your personal information for cross-context behavioral advertising.
Our Site does not respond differently to “Do Not Track” browser signals, because there is no common standard for them; we do honor GPC as described above.
5. Your California privacy rights
We are a small local business in California, and we want you to know your rights under California law, including the California Consumer Privacy Act as amended by the California Privacy Rights Act (CCPA/CPRA), to the extent they apply to us.
Categories of information we collect: identifiers (name, email, phone, IP address); commercial information (classes booked and purchased); internet or other network activity (pages visited, ad interactions); approximate geolocation; and any other information you include in your messages. We collect it from you directly, from your device, and from our service providers, for the purposes described in section 2.
We do not sell your personal information, and we do not knowingly sell or share the personal information of anyone under 16. Using Google advertising cookies to show ads to people who visited our Site may be considered “sharing” for cross-context behavioral advertising under California law; you can opt out of that using the choices in section 4, by using a GPC-enabled browser, or by contacting us. We do not use or disclose sensitive personal information for anything beyond providing our services.
As a California resident, you may have the right to:
- Know and access the personal information we've collected about you and how we use and share it;
- Delete personal information we've collected from you (with some exceptions, such as records we must keep for taxes);
- Correct inaccurate personal information;
- Opt out of the sale or sharing of your personal information;
- Limit the use of sensitive personal information (we don't use it beyond what's needed to provide our services); and
- Not be discriminated against for exercising any of these rights — you'll get the same prices and service.
To make a request, email mitchyvideos@gmail.com or call or text (949) 584-9615. We'll need to verify your request, usually by matching the name and contact details you used with us. You can also have an authorized agent make a request for you. We'll respond within 45 days, as required by law.
California's “Shine the Light” law also lets California residents ask whether we've shared personal information with third parties for their own direct marketing. We don't do that.
6. Children's privacy
Our classes are family friendly and kids are welcome, but bookings should be made by a parent, guardian or other adult. Our Site is not directed to children under 13, and we do not knowingly collect personal information online from children under 13. If you believe a child has sent us personal information, please contact us and we'll delete it.
7. How long we keep information
We keep information only as long as we need it:
- Booking requests and messages: generally up to 2 years after your last class or contact with us, so we can help with repeat bookings and questions, then we delete them.
- Payment and transaction records: as long as required for tax, accounting and legal purposes (often up to 7 years). These are kept by Square and in our business records.
- Analytics data: kept by Google according to our Google Analytics data-retention setting (no longer than 14 months for detailed user-level data).
You can ask us to delete your information sooner — see section 5.
8. Security
We use reputable providers, HTTPS on our Site, and reasonable steps to protect your information. No method of transmission or storage is 100% secure, so we can't guarantee absolute security. Please don't send card numbers or other sensitive details through our booking form, email or text.
9. Changes to this policy
We may update this policy from time to time, for example when we add a new tool. When we do, we'll change the “Last updated” date at the top of this page. If the changes are significant, we'll make that clear on the Site.
